Terms and conditions

CONDITIONS Last amended 01 January 2011

These Conditions govern your use of the Web-site, the Services and your relationship with us. Please read these Conditions carefully as they affect your rights and liabilities under the law. If you do not agree with these Conditions, please do not continue to register for the Services, use the Web-site or the Services.

THESE CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.


1. Definitions

A. Some words and phrases used in these Conditions have special meanings.

These meanings are set out below:
Word / Phrase Meaning

"Additional Services" All services available on the Web-site including the supply of personal credit scores and the supply of your Experian credit report except if your Services package means you receive free Experian credit reports.
"Agreement" The contract between us for the Services which incorporates these Conditions and includes the Insurance Conditions but not the Insurance itself.
"Credit Report Service" The online supply of your Experian credit report and the monitoring of your credit report.
"FSMA" The Financial Services and Markets Act 2000, as amended from time to time, including any conduct of business rules developed by the Financial Services Authority pursuant to such legislation.
"Fees" The fees payable for the Services.
"Identity Fraud Legal Costs Insurance" The legal costs insurance for identity fraud referred to in the Insurance Conditions. This is an optional feature of the ProtectMyID Service.
"Information" Has the meaning given in Section 6.
"Insurance Conditions" The terms and conditions applicable to the services we provide relating to the Identity Fraud Legal Costs Insurance. Click here for the Insurance Conditions.
"Lower My Bills" The service providing the ability to compare information about third party products and/ or services and includes the Product Matching Service.
"Member Area" A personalised, secure website area within the Web-site where documents and information personal to you can be accessed and where other features of the Services can be utilised.
"Month" or "Monthly" Each period of thirty (30) consecutive days (with the first period of thirty (30) consecutive days beginning on either (i) the day we make the ProtectMyID Service available to you or (ii) the day which immediately follows the end of a Trial Period (or Redemption period, where appropriate) and the second period of thirty (30) consecutive days beginning on the day which immediately follows the end of the first period of thirty (30) consecutive days, and so on).
"Payment Card" The credit or debit card used by you during Registration or such other card you choose to use at a later date.
"Product Matching Service" A feature of our Lower My Bills service which provides details of financial products and/ or services based on the likelihood of your circumstances meeting the criteria of the provider. This service uses information you provide to us or information from your Experian credit report.
"ProtectMyID Service" The online supply of one copy of your Experian credit report, the monitoring of your credit report, access to Experian's Victims of Fraud team and, at your option, the Insurance.
"Redemption Code" The code that we, one of our partners or another third party have given to you for access to the Services through a membership package you may be eligible for.
"Redemption Period" Has the meaning given in Section 3 (a)
"Registration" The completion to our satisfaction of your application to register for the Services using the Web-site.
"Services" The Credit Report Service or, if applicable to you, the ProtectMyID Service and the Additional Services.
"Third Party Contract" Has the meaning given in Section 8 (f)
"Trial" Access to some of the Services either free of charge or at a discount from the usual Fee

Depending on the Trial, conditions additional to these Conditions may apply during the Trial Period. We will agree those additional conditions with you before you accept the Trial, and will confirm those conditions by email.

PLEASE NOTE: The Trial includes unlimited online access to your credit report. Depending on the type of membership package you have, certain of the Additional Services may need to be paid for during the Trial. The Web-site automatically recognises your membership package. If appropriate, the order page on Web-site will ask for payment of any Additional Services and for the Fee due for the Trial Period.
"Trial Period" Has the meaning given in Section 3 (c)
"we" or "our" Experian Ltd, Landmark House, Experian Way, NG2 Business Park, Nottingham NG80 1ZZ, United Kingdom. Registration No. England 653331 VAT registration no: GB 887 1335 93
"Web-site" If you receive the Credit Report Service, the Web-site at address www.creditexpert.co.uk or, if you receive the ProtectMyID Service, the Web-site at address www.protectmyid.co.uk or another Internet Web-site from which we choose to provide the Services.
"Year" or "Yearly" Each twelve calendar month period beginning on either (i) the day we make the ProtectMyID Service available to you or (ii) the day which immediately follows the last day of a Trial Period and each anniversary of such day.
"you" or "your" The person applying for access to the Services.


2. The Services and Registration

A. The Services and these Conditions do not include services available to you on the Web-site which are provided by third parties. The provider(s) of these services are displayed on the Web-site and if separate terms and conditions apply to their services, they will be accessible to you within the relevant pages of the Web-site. For the ProtectMyID Service, click here for the Insurance Conditions.
B. Before your access to the Services can begin, you must complete Registration.

The following applies to Registration:
You must be 18 years of age or more at the time of applying to register.
During Registration (and before you can receive the Services) you must provide us with accurate and complete information including your full name, date of birth and address of residency details and it is your responsibility to inform us of any changes to that information (including your email address or Payment Card) by updating your details in the Member Area by using 'Update my details´.
Registration is for a single person only. During Registration you will choose a user name, password and memorable word.

We do not permit any of the following:
Any other person to share your user name, password and/ or memorable word to access the Services you have registered for; or
Access through a single Registration being made to multiple users on a network.
You are responsible for use of the Web-site made by using your user name, password and memorable word and for preventing unauthorised use of the same. If you believe there has been a breach of security such as the theft or unauthorised use of your user name, password or memorable word you must notify us immediately by contacting us.
If you have been given a Redemption Code to access the Services, you must submit this during registration in order to receive the membership package relevant to that Redemption Code.
Instant access will be provided only if your application is validated through our online authentication systems, otherwise you will either be assigned a secure PIN or we will write to you asking for further information to authenticate your application. The PIN will be sent to the address you provided at the time of your application and which you stated was your current address or we may provide it to you over the telephone. If we post the PIN to you we will send you an e-mail advising you that we have done so. If you have not received the PIN within 5 working days (or such other period as we may refer to in the e-mail) you should contact us. You will not be able to access the Web-site for the first time until you enter this PIN number along with your user name, password and memorable word.
By completing Registration, requesting Additional Services or accepting any changes to these Conditions notified to you from time to time in accordance with Section 12, you are agreeing to these Conditions.
If you have any difficulties or questions during the application process, please contact our Customer Services Team on 0800 4810800* (for the Credit Report Service) and 0844 4810001* (for the ProtectMyID Service) (Monday to Friday 9am to 6pm, Saturday 9 am to 1pm).
If you have already Registered for the Credit Report Service then you will not need to re-register for the ProtectMyID Service if you transfer to ProtectMyID before cancelling your Credit Report Service membership.

3. Period of the Agreement

This Agreement and your access to the Services will begin when Registration is complete and will end when it is cancelled.
If you are accessing the Services using a Redemption Code then the following applies:

A. Redemption Period
The Redemption Code entitles you to access the Services for a period of time which will either be stated on the Redemption Code or within any other information you received with the Redemption Code ("the Redemption Period"). Shortly after Registration we will send you a service e-mail confirming your Registration and this may also confirm the Redemption Period. PLEASE NOTE use of the Redemption Code entitles you to unlimited online access to your credit report for the Redemption Period. Depending on the type of membership package you receive, certain of the Additional Services may need to be paid for during the Redemption Period. The Web-site automatically recognises your membership package. If appropriate, the order page on Web-site will ask for payment for any Additional Services.

B. At the end of the Redemption Period
Just before the Redemption Period ends we will contact you to ask whether you wish to continue with your access to the Services outside of the redemption programme. If you choose to continue with access to the Services then this will be subject to your payment of a Monthly subscription, see Section 4 (d). If you do not wish to continue, this Agreement and your access to the Services will end at the end of the Redemption Period and you should not use or attempt to use the Services after the end of the Redemption Period unless you wish to re-register.

If you are accessing the Services under a Trial then the following applies:

C. Trial Period The Trial does not apply if you are applying for the Services using a Redemption Code and you may not be granted a further Trial if you have already received one (whether or not you cancelled the original Trial before the end of its Trial Period). The general availability and length of trials we make available from time to time is at our discretion. Trials are not available for all Services.
When you apply for the Services, the Web-site will determine the length of your Trial ("the Trial Period"), if any, which will be notified to you during the application process and will be consistent with the Trial Period referred to in any online advertising (or other promotional codes) you used to apply for the Services.
PLEASE NOTE: The Trial includes unlimited online access to your credit report during the Trial Period. Depending on the type of membership package you have, certain of the Additional Services may need to be paid for during the Trial Period. The Web-site automatically recognises your membership package which will be consistent with the features of the membership package referred to in any online advertising (or other promotional codes) you used to apply for the Services. If appropriate, the order page on Web-site will ask for payment for any Additional Services.
Shortly after Registration we will send you a service e-mail confirming your Registration and the length of the Trial Period.

D. At the end of the Trial Period
If this Agreement is not cancelled at the end of the Trial Period accordance with Section 8 , it will automatically continue until it is cancelled and you will be charged for a Monthly subscription, see Section 4 below.

4. Payments

A. Unless you are paying or have paid one of our partners or another authorised third party for access to the Credit Report Service and/ or the ProtectMyID Service and / or any Additional Services (and in which case separate conditions in addition to these Conditions may apply) and, where payment is required, you agree to pay the Fees for the Services using a valid and authorised Payment Card bearing your name. All payments taken from the Payment Card will be in pounds Sterling.

B. From time to time we may change the Fees payable for the Services. If we do so we will notify you of any change before it is effective. Notification may be in the form of an e-mail, a notice on the Web-site or, for Additional Services, before they are purchased. We recommend that you regularly check the Web-site for any such notices.

C. PLEASE NOTE: If the type of membership or Services package you receive means you pay for any of the Additional Services then each such Additional Service you request must be paid for at the time of your request and is not subject to the refund referred to in Section 8 (g) of these Conditions. The Fee payable for each Additional Service will be debited from the Payment Card at the rate relevant to your membership package (and shown on the order page for the Additional Service you request) on each occasion that an Additional Service is requested.

D. Unless you are a lapsed member of the Credit Report Service (see Section 16 of these Conditions), the cost of using the Lower My Bills service is included within the Fees for the Credit Report Service, but please note we may receive commission and fees from certain third parties who advertise on or are linked to the Web-site or as a result of you having purchased products and/or services after using the Lower My Bills service. All such commission and fees shall be retained in full by us. If after using the Lower My Bills service you decide to apply for a product or service, the charges and payment terms will be subject to the providers relevant terms and conditions.
THE REST OF THIS SECTION DOES NOT APPLY DURING A TRIAL PERIOD OR REDEMPTION PERIOD BUT MAY APPLY IF YOUR USE OF THE SERVCES CONTINUES BEYOND THE TRIAL PERIOD OR REDEMPTION PERIOD

E. The Fees for the Credit Report Service or, if applicable to you, the ProtectMyID Service will be debited from the Payment Card on the following occasions:
For a Yearly subscription, on the first day of the first Year and each subsequent Year, for as long as this Agreement continues. Renewal membership fees will conveniently and automatically be charged, at the then current rate, to the Payment Card until you cancel this Agreement; or
For a Monthly subscription, on the first day of the first Month and at the beginning of each subsequent Month, for as long as this Agreement continues. Renewal membership fees will conveniently and automatically be charged, at the then current rate, to the Payment Card until you cancel this Agreement.
By way of example only:
Example 1: Where the Trial Period is free of charge, if successful completion of Registration is on the 1st March and the Trial Period is 30 days, then the first payment of the Monthly subscription Fee is on the 31st March, the second payment of the Monthly subscription Fee is on the 30th April, the third payment of the Monthly subscription Fee is on 30th May and so on.
Example 2: Where the Trial Period is free of charge, if successful completion of Registration is on the 1st January and the Trial Period is 15 days, then the first payment of the Monthly subscription Fee is on the 16th January, the second payment of the Monthly subscription Fee is on the 15th February, the third payment of the Monthly subscription Fee is on the 17th March (assuming there are 28 days in February) and so on.

F. By agreeing to these Conditions you authorise us to use the information about the Payment Card to verify your identity, to set up your use of the Services and, where appropriate to your membership package, charge the Fees for the Services in accordance with these Conditions.

G. YOU UNDERSTAND THAT THIS AUTHORITY IN FAVOUR OF THE PAYMENT CARD WILL REMAIN IN FORCE UNTIL YOU CANCEL IT. CANCELLATION OF THE AUTHORITY IN FAVOUR OF THE PAYMENT CARD WILL BE CONSIDERED AS A REQUEST TO TERMINATE THIS AGREEMENT IN FULL INCLUDING ALL ELEMENTS OF THE SERVICES. YOU CAN NOTIFY US OF YOUR CANCELLATION OF THIS PAYMENT CARD AUTHORITY OR YOUR RECEIPT OF THE SERVICES BY:
telephoning us on 0800 561 0083 (for the Credit Report Service) and 0844 481 0001* (for the ProtectMyID Service) - Monday to Friday 9am to 6pm, Saturday 9am to 1pm; or
by writing to us at CreditExpert, PO Box 7710, Nottingham NG80 7WE (for the Credit Report Service) and at ProtectMyID, PO Box 9639, Nottingham NG80 1AE (for the ProtectMyID Service).

* Calls cost 5p per minute from a BT landline; calls from other networks may vary and include a connection fee. Calls may be recorded for training and monitoring purposes.

H. Please note that we are not responsible for any overdraft or "over the limit" charges or bank fees if your Payment Card account or facility contains insufficient credit or funds when the Fee is processed and charged to the Payment Card.

I. If you choose to transfer from one Services package to another and if the subscription Fees for the new Services package are different, then the change in the Fees for the new Services package you have chosen will be effective the month after the month in which you have transferred.

5. Access to the Services

A. By ordering a copy of your credit report you will have access to the information that is available to us in the United Kingdom and that could be taken into consideration by a lender using us as a credit reference agency. This will include public information and financial details. Your request for a copy of your credit report is the statutory credit report produced by us under Section 7 of the Data Protection Act 1998.

B. We can only provide you with a copy of your own credit report and, if applicable to your Services package, your own personal credit score. If you use the Product Matching Service then we will only use the information you have given to us or the information in your Experian credit report (depending on which option you have selected).

C. A record of each of your requests for (i) a copy of your Experian credit report as part of the Credit Report Service or, if applicable to you, the ProtectMyID Service and/ or (ii) use of information in your Experian credit report for the Product Matching Service will be retained by us for 12 months. Each time you log into the Credit Report Service an automatic request for your Experian credit report will be made. If you request a copy of your Experian credit report (including when logging into the Credit Report Service) then it will include a record of your previous requests in the 12 months which precede the date of your then current request. Your requests will ONLY be visible to you and NOT to any lenders. Therefore these requests will not be taken into consideration in any lending decision.

D. The Credit Report Service will also give access to online tools and articles and will provide weekly alerts for certain changes to your Experian credit report.

In the case of the Credit Report Service alerts are provided if any of the following categories should change:
• Addition or deletion of a credit account;
• A change in the payment history of a credit account;
• Addition or deletion of Court Judgments;
• A search made of your Experian credit report;

In the case of the ProtectMyID Service the following fraud alerts are provided:
• Addition of a credit account; and
• A search made of your Experian credit report

E. We are continually seeking to improve the Services. We may, at our discretion, modify or discontinue any of the Services or content or a portion of the Service, provided such modification or discontinuance does not materially reduce the nature of the Services we provide to you. If such modification or discontinuance does materially reduce the Service, you may cancel the Services in accordance with Section 7 below.

F. All transactions are protected by secured socket layer and firewall technology. Transactions are also encrypted to a minimum of 128 bits.

6. Use of Information

A. All information delivered to you by us during the provision of the Services (including but not limited to the credit report monitoring and personal credit scores) ("the Information") belongs to us or our licensors. Any use of Information not in accordance with this Agreement entitles us to cancel this Agreement. The Information does not include documentation provided or made available to you in relation to the Insurance.

B. You may display the Information on a computer screen or take reasonable copies of the Information or store the Information in electronic form on a computer provided that the Information is always used for your own personal and non-commercial purposes.

C. Except as expressly set out above, you may not reproduce, modify or in any way commercially exploit any of the Information. In particular, but without limiting the general application of the restrictions contained in the preceding sentence, you may not do any of the following without prior written permission from us:
Redistribute any of the Information;
Remove any copyright or trade mark notice applied to any of the Information;
Create a database in electronic or structured manual form by systematically downloading and storing all or any of the Information.

D. For security reasons and to protect confidentiality, we will verify your identity by checking the details you provide during Registration against details held on databases to which we have access to for this purpose. A record of this check will be kept and may be used by other organisations for verification and fraud prevention purposes. We will check your details with the records we hold and with other fraud prevention agencies. If you provide false or inaccurate information and we suspect fraud we will record this. If you want to receive details of those fraud prevention agencies from whom we obtain and with whom we record information about you, write to us at Experian Ltd, PO Box 8000, Nottingham, NG80 7WF (for the Credit Report Service) and ProtectMyID, PO Box 9639, Nottingham NG80 1AE (for the ProtectMyID Service). You have a legal right to these details. We and other organisations may use and search these records to:
Help make decisions about credit card and credit related services;
Help make decisions on motor, household, credit, life and other insurance; proposals and insurance claims for you and members of your household;
Trace debtors, recover debt, payment fraud and manage your accounts or insurance policies;
Check your identity to prevent money laundering unless you provide other satisfactory proof of your identity.

7. Use of Redemption Codes

A. Use of Redemption Codes is subject to these Conditions and any other specific conditions notified to you on the issue of the Redemption Code. Use of any Redemption Code may also be subject to proof of entitlement to use the Redemption Code.

B. Redemption Codes cannot be exchanged for cash or used to pay for any other services that we or our group companies provide. If membership is cancelled during the Redemption Period you will not be entitled to a refund or other credit from us. If you received the Redemption Code from one of our partners or another authorised third party, please refer to any additional conditions given to you when you received the Redemption Code.

C. Unless Section 7 (d) applies, the right to use a Redemption Code is personal to the original recipient and, unless we expressly agree to the contrary, may only be used once.

D. If you have separately been given a lawful right to distribute Redemption Codes then you agree that such distribution will not be for commercial purposes.

E. You agree not to remove, erase or interfere with any copyright or trademark notice or any security device contained in or on the Redemption Code.

F. Any distribution of Redemption Codes which is without our approval in writing is not permitted and we may refuse to accept or cancel the use of Services provided following the submission of any Redemption Code which contravenes this Section 7.

8. Suspension, Cancellation and Refunds

A. The Services and the Web-site may be temporarily suspended if our computer systems used to provide the Services are under repair or maintenance or are otherwise unavailable. We will attempt to restore the availability of the Services as soon as we reasonably can.

B. If we reasonably believe that a Redemption Code is being used unlawfully or illegally we may reject any such Redemption Code and/ or cancel access your access to the Services. You agree that you shall have no claim against us and that we have no liability to you in contract, tort or otherwise in respect of such rejection or cancellation. We reserve the right to take any further action we deem appropriate in such circumstances.

C. You may cancel the Services and this Agreement at any time. However, because we begin to set up and provide the Services immediately following completion of Registration and in the case of personal credit scores upon request, you will not be permitted to cancel this Agreement as provided in the Consumer Protection (Distance Selling) Regulations 2000. D. If you cancel the authority for us to charge the Fee to the Payment Card, we will treat this as a request by you to cancel this Agreement.

E. If you cancel your access to the Credit Report Service or, if applicable to you, the ProtectMyID Service, we will treat this as a request to cancel this Agreement (including your access to any Additional Services).

F. If you receive access to the Services as part of a contract you have with a third party (for example as an employment benefit or a value added service to a service provided by that third party) (a "Third Party Contract") then your entitlement to access the Services may be cancelled on a particular date, after the occurrence of a particular event or at the request of that third party. We may also cancel your access to the Services if that third party notifies us that you are not entitled to have access. Any cancellation under this Section 8 (f) will not have affect on any rights, duties or obligations you may have under that Third Party Contract but if you choose to cancel this Agreement under Section 8 (c) before the end of any minimum period committed to in the Third Party Contract then this could affect your rights, obligations and liabilities under that Third Party Contract. If you have any queries about the affect of cancellation of this Agreement on any such Third Party Contract, you should contact the relevant third party.

G. In relation to the Credit Report Service only, depending on when you cancel the Credit Report Service you may be entitled to receive a refund of all or part of the Fee paid for the Credit Report Service. If you have not paid a Fee for access, you will not be entitled to a refund. Your cancellation must be communicated by contacting our Customer Services Team by telephone on 0800 561 0083 (for the Credit Report Service) and 0844 481 0001* (for the ProtectMyID Service) - Monday to Friday 9am to 6pm, Saturday 9am to 1pm. Your refund of the Fees for the Credit Report Service will be calculated up to the date we receive your notice of cancellation ("the Notice Date") in accordance with the following:

Yearly Subscriptions (not available for all Services)

Cancellation during the Trial Period: where the Trial Period was free of charge, there was no charge to your Payment Card so no refund is required.
Cancellation after the end of the Trial Period (where the Trial Period was free of charge) but before the 91st day of the first Year: unless we agree with you otherwise we will subtract from the Fee the proportion of the Fee calculated as the number of whole days remaining of the 90 day refund period which operates for the first 90 days of the first Year in accordance with the following calculation:

Fee minus ((N/360) multiplied by the Fee) = £ refund amount Where N = the number of whole days since the start of the first Year up to the Notice Date and 360 is the number of days for a complete Year which for the purposes of calculating a refund is 12 x 30 days. For example if you successfully registered on 1st August 2003 and your Trial Period is 30 days we will charge the fee to the payment card on 1st September 2003. If you cancel on 10th October 2003 40 days will have passed since 1st August 2003. The refund will therefore be calculated as Fee minus 40/360 x Fee = £ refund amount.

Cancellation either (a) where the Fee during the Trial Period was at a discount, or (b) where the Trial Period was free of charge, if cancellation was before the 31st day of the second year or a subsequent Year: unless we agree with you otherwise we will subtract from the Fee a proportion of the Fee calculated as the number of whole days remaining of the refund period which operates for the first 30 days of the second and each subsequent Year in accordance with the following calculation:

Fee minus ((N/360) multiplied by the Fee) = £ refund amount

Where N = the number of days since the start of the second and each subsequent Year up to the Notice Date and 360 is the number of days for a complete year which for the purposes of calculating a refund is 12 months x 30 days. For example if you successfully registered on 1st August 2003 we will charge the fee to the payment card on 1st September 2003 and again on 1st August 2004. If you cancel on 25th August 2004 25 days will have passed since 1st August 2004. The refund will therefore be calculated as Fee - 25/360 x Fee.

Monthly Subscriptions

Cancellation during the Trial Period: where the Trial Period was free of charge, there was no charge to your Payment Card so no refund is required.
Cancellation after the end of the Trial Period (where the Trial Period was free of charge): you will not be eligible for a refund of any amount you have paid for your current Month's subscription fee.
For Monthly subscriptions (and Trials where the Fee during the Trial Period was at a discount): cancellations on or before the last day of the then current Month are required for cancellation to be effective from the beginning of the next Month.

H. We have the right, at our discretion, to suspend or cancel your Registration, use of the Services, this Agreement and/or provision of Information immediately if we notify you that we have reasonable grounds to suspect that any information provided by you either before or after Registration is untrue or inaccurate, when there is any use of your user name, password or memorable word which is not in accordance with these Conditions or for any other reason at our reasonable discretion.

I. We may also suspend or cancel your Registration and terminate your use of the Services immediately if we notify you that (i) we reasonably believe that your use of the Services is excessive or is likely to degrade the performance of the Services for other members subscribed to it (ii) you have committed a serious breach of these Conditions or (iii) if you become bankrupt.

J. Without affecting your rights under Section 8 (g) above, we may also cancel your Registration and terminate your use of the Services by giving you notice provided that such termination will not take effect until the end of the current Year (for Yearly subscriptions) or the end of the current Month (for Monthly subscriptions).

K. Your entitlement to receive the Services at the level of your subscription for your membership package ends if the Services are cancelled (whether cancelled by you or us). If you re-register for the Services at a later date (and successfully complete Registration) then you will pay the subscription which applies to the Services at the time you re-register.

9. Liability

A. If you have any of the following problems with the Information you must contact us as soon as possible:
You are unable to download the Information and/or do not receive the Information; or
The Information you receive is damaged for reasons or circumstances beyond our or your reasonable control; or
The Information that you receive appears to be materially inaccurate.

B. As soon as we receive and have verified your complaint and, where we are reasonably able to do so, we will re-supply the Information or otherwise replace any defective Information at our own cost as soon as reasonably possible and in any event within 15 days from receipt of your complaint.

C. Due to the nature of the Information provided, you acknowledge and agree that the value, accuracy, and/or relevance of the Information will diminish after the Information is delivered by us. In this context, we do not guarantee that the Information will retain any value, accuracy and/or relevance after delivery by us.

The Information may include or use personal credit scores and utilise educational tools including credit calculators designed to allow you to model "what if" scenarios using empirical and statistical data. The Information will provide indicative predictive results only and as such is not a guarantee of any particular outcome including (but not limited to) that any particular product provider will accept your application for their product or service. You should not therefore use any Information, or any part of it, as the sole basis for any decision. In addition and specifically in connection with the Lower My Bills service: (i) we cannot take responsibility for a product or service being withdrawn from the market or the features of such product or service being changed by the provider; and (ii) in the case of the Product Matching Service, we do not accept responsibility for a change in the financial product provider´s criteria for successful applicants, or a relevant change in your personal circumstances, after you have used this service if the change affects the likelihood of you being accepted for a product or service you have chosen from the search results we provided.

E. We do not accept any responsibility for any loss that may arise from relying on the Information other than as specifically set out in this Section.

F. We will use all reasonable skill and care in: (i) the supply of the Information to you (ii) the collection of third party data included within your Experian credit report (iii) for the Lower My Bills service, the collection of information for third party products and/ or services displayed on the Web-site (iv) for the Product Matching Service, the collection of the financial product provider´s criteria for successful applicants and (v) if you receive the ProtectMyID Service, the provision of that service.

G. Due to the number of third party sources from which we obtain Information (including the details you provide to us) and the nature of electronic distribution via the Internet, we cannot give you a guarantee or warranty that any Information is complete, accurate, up-to-date or error-free, of a satisfactory quality or fit for any particular purpose. We do not warrant that the Web-site or the Information is virus-free or that the operation of the Web-site will be continuous, uninterrupted or error free. Any Information that you download to your computer or otherwise obtain through the Web-site is at your own discretion. You bear all the risks associated with use of the internet. You will be solely responsible for any damage to your computer or any of your data that results from you downloading any of the Information. We exclude all warranties (whether express or implied) to the extent that we are legally allowed to exclude them.

H. Our liability to you arising in contract, tort or otherwise from your use or inability to use the Web-site, or any Information or from any action taken (or refrained from being taken) as a result of using the Web-site or any Information or any breach by us of Section 9 (f) is limited as follows (subject to any rights that you have under the Cancellation section or in respect of the Information):
We have no other liability to you until we have received notice of your problem and our liability to you is limited in total to a sum equal to the then current annual standard fee for the Credit Report Service or, if you receive the ProtectMyID Service, the then current annual standard fee for the ProtectMyID Service;
We have no other liability for any problems, delays or defects in the Information if such problems, defects or delays are caused by any event or circumstances beyond our reasonable control or information which is provided to us;
We do not accept any liability to you for any indirect or consequential loss or damage arising out of the Information or your use of the Web-site;

I. Nothing in these Conditions limits our liability to you for death or personal injury resulting from our (or our employees or sub-contractors) negligence or excludes or limits our duties or any liability under FSMA or for any other liability that we cannot legally limit or exclude.

J. Without prejudice to any right you may have to a refund under Section 8 (g), we shall have no liability to you in contract, tort or otherwise for ending this Agreement or suspending or terminating your access to the Services pursuant to Section 8.

K. We shall have no liability to you in contract, tort or otherwise relating to any Third Party Contract (or your decision to enter into such Third Party Contract), including but not limited to any affect on your tax or pension position that entering into this Agreement. If you have any concerns about this you should raise them with the relevant third party and/ or seek independent advice.

10. Privacy and your information

A. We take your privacy very seriously and aim to comply with the relevant provisions of UK data protection legislation. Any information given to us by you or collected by us during your use of the Web-site is only used in accordance with these Terms of Service and our the Privacy Policy for the Credit Report Service or the Privacy Policy for the ProtectMyID Service.

B. You grant us a worldwide, royalty-free, non terminable licence to store and use the information you provide to us when using the Services.

11. Third Party Web-sites

A. The Web-site may contain links to other World Wide Web web-sites, either directly or through frames and, where possible, we will make clear where such links are being made. The availability of such third party material does not constitute any form of recommendation, endorsement or publication of such third party material by us. Those web-sites are provided by independent third parties and we are not responsible for their availability or content.

B. Any arrangements made between you and any third party named on this Web-site or linked to from this Web-site are at your sole risk and responsibility.

C. You may not link to the Web-site without our prior written permission.

12. Changes to these Conditions

A. Sometimes, because of changes to the Services, changes in the law or our arrangements with third parties, we may have to make changes to these Conditions. Changes will be indicated at the start of these Conditions by reference to the date on which they were last modified which may be after the date on which you complete Registration. It is important, therefore, that you regularly check these Conditions. If you use the Web-site after we have notified you of the changes to these Conditions (either by email or on the Web-site), you agree to be bound by those changes. If you do not agree to be bound by those changes, you should not use the Web-site any further and cancel this Agreement in accordance with Section 8.

13. Third Party Rights

A. Only you and we have legal rights under these Conditions. Under the Contract (Rights of Third Parties) Act 1999, no-one else will be able to enforce any part of the Conditions.

14. Law

A. These Conditions shall be governed by and understood in accordance with English law.

B. You and we agree that the Courts of England shall have the exclusive jurisdiction to determine any disputes which may arise out of, under, or in connection with this Agreement.

15. General

A. The rights granted in this Agreement are personal. You may not assign, sub-license or otherwise transfer any of your rights under these Conditions.

B. If a court finds any part of these Conditions to be invalid such part will be deleted and the remaining parts of these Conditions should be unaffected.

C. If either of us fails to exercise any right or legal remedy available to either you or us any such failure shall not prevent you or us from relying on these at a later date.

D. Headings in these Conditions are for convenience only and will have no legal meaning or effect.

Complaints: In the unlikely event that you have cause to complain your complaint can be sent by e-mail to customerservice@creditexpert.co.uk (for the Credit Report Service) and to customerhelp@protectmyid.co.uk (for the ProtectMyID Service) or by post to CreditExpert, PO Box 9639, Nottingham NG80 7WE (for the Credit Report Service) and ProtectMyID, PO Box 9639, Nottingham NG80 1AE (for the ProtectMyID Service). If we are unable to settle your complaint to your reasonable satisfaction through the means stated above, you may refer the matter to the Financial Ombudsman Service at South Quay Plaza, 183 March Wall, London, E14 9SR.

G. Experian Limited is an Appointed Representative of Motorfile Limited (company number 03009493, whose registered office address is Experian Ltd, Landmark House, Experian Way, NG2 Business Park, Nottingham NG80 1ZZ, United Kingdom). Motorfile Limited is a company regulated by the Financial Services Authority (FSA FRN 313967) to conduct the regulated business of introducing and arranging insurance products and mortgages.

16. Lapsed Members

A. If your membership of the Credit Report Service has ended we may invite you to use certain of the free Services available on the Web-site. You may not be required to go through Registration again and if you do not you will be required to accept Sections 1, 4 d., 6 and 9 to 16 of these Conditions before receiving the free Service, each time you use such Service.

B. Any invitation we send to you as a lapsed member of the Credit Report Service will give you the opportunity to unsubscribe from being contacted again.
